Will international mechanisms be able to provide compensation for losses from the war?
Andriy Klymosyuk, the head of the ILI projects, spoke about this in his commentary for Radio Liberty. He stressed that compensation for the damage caused should be made at the expense of the aggressor country, and currently, the international compensation mechanism is one of the most promising ways to do this.
‘This is a special tool that the Ukrainian government and partner states are working on, which will allow for real coverage of losses and compensation, including at the expense of the aggressor's assets,’ said Andriy Klymosiuk.
In particular, this mechanism will become a key tool for compensating losses incurred by Ukrainians who lost their homes or other real estate as a result of the war. This is especially important for residents of cities such as Mariupol, where up to 90% of the housing stock has been destroyed by rocket attacks and shelling.
The Register of Damages, as the first element of the compensation mechanism, is already in operation and accepts applications under the first category.
However, not only those whose homes have been damaged or destroyed can apply for future compensation.
"There are other categories. That is, if an apartment or house remains in the occupied territories, but it is undamaged, and the person has left and has no access to it, they will also be able to receive compensation for the inability to use their property in the future,’ the expert emphasises.
The next step in implementing the compensation mechanism will be the creation of a special compensation commission. It will be tasked with reviewing applications and determining the amount of compensation for each specific case.
It is expected that the main source of the compensation fund will be frozen Russian assets, including sovereign assets and income from them. In addition, the fund may also receive funds from the confiscation of assets of violators of anti-Russian sanctions.
