The ILI team continues to share Ukraine`s expereince in recovering seized assets with international partners

Institute of Legislative Ideas analyst Bohdan Karnaukh spoke at a conference at the University of Luxembourg, where participants discussed economic sanctions, their enforcement, and mechanisms for implementation. The event brought together representatives of European institutions, business, in-house counsels of multinational corporations, and scholars from across different countries.

The focus of his presentation was Ukraine’s mechanism for confiscating assets in favor of the state – a unique legal tool that allows the state to seize property of individuals and companies supporting Russia’s aggression without a prior criminal conviction.

The mechanism has already proven effective in practice: rulings by the High Anti-Corruption Court of Ukraine have enabled the state to confiscate assets belonging to Russian oligarchs and companies involved in financing the war, with the recovered funds directed toward reconstruction and strengthening Ukraine’s defense capacity.

The discussion drew significant attention from European colleagues, particularly in the context of the recent M.S.L., TOV v. Ukraine case and the broader EU debate on balancing property rights, proportionality, and national security.
