How to ‘pocket’ state property or the draft law No. 5202 On Organisations of Water Users and Stimulation of Hydraulic Land Reclamation

The ILI found a number of corruption risks in the draft law:

  • the adoption of the document may lead to illegal alienation of state property and create grounds for corruption in the management of state property;
  • water user organisations will receive privileges that allow them to appropriate state and municipal property free of charge. This reduces the transparency and competitiveness of the transfer of ownership of such property;

How to create artificial obstacles to licences or the draft law No. 5125 ‘On Credit Unions’:

  • The draft law establishes artificial obstacles to obtaining a licence to issue loans;
  • The regulator will be able to determine the grounds for an inspection (unscheduled) at its discretion, determine the amount of the fine, or even apply it without clear criteria for this.

How to restrict the circulation of medicines ‘at your own discretion’ or the draft law No. 5547 on medicines

Our analysts have identified opportunities for corruption in this document, in particular

  • the draft law does not define a clear list of powers of the state control body. This means that officials will be able to make decisions on registration, market authorisation, control over circulation and pharmacovigilance of medicines at their own discretion;
  • another serious drawback is the absence of grounds for unscheduled inspections in the draft law. This gives the state control body the right to conduct such inspections at its own discretion.
