The ILI has analysed the draft laws that the Verkhovna Rada submitted for the first and second reading this week. Based on the results of anti-corruption expertise, we have identified the top 3 acts that contain corruption risks. Very soon they may become laws that will affect each of us

Would you like to receive $8-10 thousand from the state for education, medical treatment or an apartment? The President proposes to create a state fund for future generations, which will be replenished from the proceeds of mining rents.Starting in 2037, the Fund will pay 18-year-old Ukrainians a one-time sum of about $8-10 thousand for education, medical treatment or an apartment
It sounds tempting, but it's not that simple. After all, economic and corruption threats lurk beneath the beautiful promises:
- According to the Centre for Economic Strategy, budgetary expenditures in the form of contributions to the Fund could amount to about 1% of GDP per year in 2030, which is billions of hryvnias, or about a third of the budget deficit that is considered safe (about 3% of GDP), about one tenth of the Pension Fund's expenditures, or a third of defence spending today.
- The Fund is being created as an organisation without clear criteria and safeguards for its functioning.The officials and members of the Fund's Board will not be subject to the provisions of the Law on Prevention of Corruption. In addition, there are no clear criteria for remuneration of the Fund's employees. This contributes to inefficient and non-transparent spending of budget funds.
Realtors without borders or the draft law No. 3618 on real estate activity (to be considered in the first reading)
The ILI found corruption risks in the draft law:
- It will be impossible to dispose of your property without a realtor.
- The need to enter information into the Register with limited access may result in the payment for such certificates and corruption schemes.
- One organisation of realtor self-government will actually be able to control the entire sphere of activity of realtors.The choice of such a lucky person will be non-transparent, and his powers will be extremely broad. At the same time, the state's influence will be minimal, if not zero.
Hundreds of thousands out of open procurement or draft law No. 6537 (to be voted on in the first reading)
- The draft law removes certain categories of works and services procured by local authorities from competitive procedures
- It creates a backlash to remove budget procurement of up to UAH 500,000 from open tenders. This will contribute to inefficient and non-transparent spending.
