President of Ukraine Volodymyr Zelenskyy has submitted to the Parliament vetoed Draft Law No. 7194‘On Amendments to Certain Laws of Ukraine on Improving the Effectiveness of Sanctions Related to Assets of Individuals’ with proposals.
These proposals change the proposed mechanism of asset confiscation.
The Institute of Legislative Ideas conducted a thorough analysis of the Draft Law No. 7194 to identify risks that may become the basis for future appeals in courts, including the ECHR, and controversial issues that may reduce the effectiveness of the asset confiscation process, as well as to provide recommendations for their elimination.
This document contains a general analysis of the vetoed draft law, taking into account the new changes proposed by the President in the format of advantages and disadvantages/risks.
"In this document, we have reflected the main changes that the Law may undergo after taking into account the President's proposals and the benefits of the proposed provisions. At thesame time, we have identified certain drawbacks and risks that may give rise to future appeals in courts, including the ECHR, and reduce the effectiveness of the asset confiscation process," the analysis says.
