Draft law No. 7438 on the use and circulation of pyrotechnic products registered in the Rada

The draft law proposes to prohibit the sale, transfer and use of any fireworks, including salutes and firecrackers, and any events using pyrotechnic products and explosives. The only exceptions are stage pyrotechnics and fireworks that have a low level of danger and a low level of noise.

In addition, the draft law proposes to ban the use of any pyrotechnic products on animals.

Who will be allowed to launch fireworks?

Upon the decision of the local council, fireworks of class F1 (with a very low level of danger and low noise), as well as stage pyrotechnics of class T1 and T2 are allowed to be used to celebrate holidays and non-working days, city days, other holidays or sports competitions.

The use of pyrotechnic products is also permitted for the Armed Forces of Ukraine (hereinafter referred to as the ‘AFU’), the National Police and emergency services.

But there is one ‘BUT’. According to the proposals of the draft law, the use of fireworks and firecrackers, as well as any events with the use of pyrotechnic products and explosives are PROHIBITED.

At the same time, the current legislation contains a similar prohibition on the use of salutes, fireworks and pyrotechnics, but has a time limit of ‘between twenty-two and eight o'clock’. Thus, we have two parts of the same article, one of which completely prohibits the use of pyrotechnics, and the other allows its use from 8 am to 10 pm.

This shortcoming gives the National Police officers the right not to prosecute some people who used prohibited pyrotechnics, for example, in the evening, and to bring others to administrative responsibility under similar circumstances.

TheInstitute of Legislative Ideas supports the adoption of this draft law. However, it draws attention to the need to improve some of its provisions.
