Draft law No. 7588 has been registered in the Rada, which aims to improve the efficiency of land use.

However, we have found corruption risks that could negate all the advantages of the draft law:

  • Officials will be able to approve the withdrawal of a land plot from permanent use at their discretion . At the same time, the draft law does not specify the procedure for such approval.
  • According to the draft law, the withdrawal of a land plot from the permanent use of a state enterprise, institution or organisation, as well as the transfer of the withdrawn land plot to the ownership or use of other persons, is subject to the approval of the executive authority. BUT! It is not possible to clearly define what kind of transfer of land plot and to which ‘other persons’ it refers.

All of this contributes to corruption risks and possible abuse of the approval process, such as delaying the timeframe for granting it as a basis for extortion of bribes.
